“Twitter is not entitled to get legal protection”: Ravi Shankar Prasad.

legal protection,twitter update,twitter case,new it rules,

All is not well in India for the micro-blogging platform Twitter. Twitter has now lost its legal shield to third-party content. That is, from the government, he will not be given any kind of security regarding the content.

In simple words, now action can be taken against Twitter under IPC sections. Twitter itself is responsible for this situation. Now the road ahead has become difficult for Twitter, there is no doubt about it.

Actually, from May 25, new IT rules have come into action in India. Which Every digital company has to follow. Due to the new rules, all IT companies have to appoint some executives in India.

But Twitter did not follow the guideline. According to sources, for this the company was given additional time and several reminders.

The Ministry of Electronics and Information Technology had issued new IT rules on February 25, 2021, which have been implemented from May 25.

In the new rules, many important things have been said for IT companies like Twitter, Facebook, WhatsApp, Google, Instagram, YouTube, and others. If the companies do not accept these things, then the intermediaries from the government will end.

Social media platforms that have more than 5 million users will have to have a Chief Grievance Officer, a Nodal Officer, and a Chief Compliance Officer. All of them must be residents of India.

Companies will have to clearly specify the complete details of the Gravity Officer and the way to contact them. That is the contact number of the officer, the process of making a complaint will have to be told.

Confirmation of receipt of user complaint has to be informed within 24 hours. It has to be resolved within 15 days. If the user has objected to the content, then it will have to be removed within 36 hours. Content containing pornography and nudity must be removed within 24 hours.

In this case, Supreme Court lawyer and cyber law expert Virag Gupta said that under Section 79 of the IT Act, companies like Twitter have legal facilities and security cover under intermediaries.

For this, the government had made rules in 2011 and now in 2021, they have been implemented with new amendments. The government says that Twitter is not following these rules, so the protection given to it under section 79 has been abolished.

In such a situation, now civil and criminal liability becomes on him regarding the content. That is, now Twitter will be fully responsible for the content on which the objection comes. A police complaint will be filed on that.

When the farmers' movement was started in India, Twitter was a constant target of the government. After pressure from the government, he had to remove many posts. Also, many accounts had to be deleted.

The advantage of this tug of war with the government was the Koo app, which is called indigenous Twitter. From many big politicians of the country to Bollywood stars, they have made their account on Koo.

Now more than 50 lakh users have been connected to Koo. In such a situation, if the government tightens the screws on Twitter due to the new IT rules, then Koo is sure to get the benefit.
